1. Acceptance of These Terms
These Terms form a binding agreement between you and MonkPop. If you do not agree, do not access or use the service. Our Privacy Policy explains how we handle personal data and forms part of your use of the service. Additional rules shown for a feature, event or community also apply to that feature.
2. Eligibility and Age Requirement
You must be at least 18 years old and legally able to enter into a binding contract to use MonkPop. You may not use the service if doing so is prohibited by applicable law, if your account has been terminated for serious or repeated violations, or if you are subject to restrictions that make use unlawful. By using MonkPop, you represent that you meet these requirements.
3. Accounts and Security
You must provide accurate information, keep it current and protect your sign-in credentials. You are responsible for activity under your account unless caused by MonkPop’s failure to use reasonable security. Do not share, sell or transfer an account without our written permission. Notify us promptly of suspected unauthorized access. We may require verification to protect the account, other users or the service.
4. What MonkPop Provides
MonkPop is a social discovery service centered on circus, carnival and live-performance culture. Features may include event discovery, profiles, community photos and videos, performance clips, voice introductions, posts, comments, reactions, direct messages, event participation, reporting and blocking. Features, availability and eligibility may differ by region, device or account and may change over time.
MonkPop does not guarantee that an event, venue, organizer, performer, user or piece of content is accurate, available, safe or suitable for you. Use your own judgment and follow venue rules and local law.
5. Acceptable Use
You must not use MonkPop to:
- threaten, harass, stalk, exploit, impersonate or endanger another person;
- post hateful, discriminatory, sexually exploitative, violent, illegal or deceptive content;
- share another person’s private or confidential information without authorization;
- promote self-harm, trafficking, terrorism, criminal activity or dangerous acts;
- send spam, scams, unsolicited commercial messages or misleading event information;
- infringe copyright, trademark, privacy, publicity or other rights;
- upload malware, interfere with security, scrape the service, reverse engineer protected components, or access accounts or systems without authorization;
- use automated systems to create accounts, collect data or manipulate engagement without written permission; or
- evade enforcement, misuse reports, or assist another person in violating these Terms.
We may consider context, severity, intent, risk and prior conduct when enforcing these rules.
6. Your Content
You retain ownership of content you create and share. You grant MonkPop a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, adapt for technical formatting, distribute, display, perform and otherwise use that content only as needed to operate, secure, improve and promote the service. This license ends when content is deleted from our active systems, except where continued retention is technically necessary or legally permitted, or where others have shared the content outside MonkPop.
You represent that you have the rights and permissions needed to post your content and grant this license. Do not upload content featuring performers, audience members, music, artwork, venues or events unless your use is lawful and consistent with applicable rules. You are responsible for your content and interactions.
7. MonkPop Content and Intellectual Property
The service, software, brand, logos, interface, design and content supplied by MonkPop are owned by or licensed to MonkPop and are protected by intellectual-property laws. Subject to these Terms, MonkPop grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the service for its intended non-commercial purpose. No other rights are granted.
If you believe content infringes your copyright or other rights, contact us with your identity, the protected work, the location of the material, your good-faith statement, and information sufficient for us to evaluate the request.
8. Events and Third-Party Services
Event listings may be provided by organizers, venues, users or third parties. Dates, availability, admission rules and safety requirements can change. Confirm important details with the organizer before attending. Third-party ticketing, maps, payment, authentication or other services are governed by their own terms and policies. Unless expressly stated, MonkPop is not the organizer, seller or operator of an event and is not responsible for third-party acts or omissions.
9. Safety, Reporting and Moderation
Use reporting and blocking tools for unwanted interactions or content. We may review content, communications and account signals where permitted by law and reasonably necessary to investigate reports, protect safety, enforce these Terms or maintain service integrity. We may remove or restrict content, limit features, issue warnings, preserve evidence, notify affected users or authorities, or take other proportionate action.
MonkPop cannot monitor every interaction and does not perform comprehensive background checks. Take reasonable precautions when communicating with or meeting people. MonkPop is not an emergency service; contact local emergency services if anyone faces immediate danger.
10. Suspension, Termination and Account Deletion
You may stop using MonkPop at any time and request account deletion through the available account controls or our Contact page. We may suspend, limit or terminate access when reasonably necessary to protect users or the service, comply with law, investigate risk, or respond to a material or repeated breach. Where appropriate and legally required, we will provide notice and an opportunity to appeal. Sections intended by their nature to survive termination will remain effective.
11. Disclaimers
To the maximum extent permitted by law, MonkPop is provided “as is” and “as available.” We do not make warranties of uninterrupted operation, error-free performance, complete security, accuracy of user or event content, or that interactions will meet your expectations. We disclaim implied warranties of merchantability, fitness for a particular purpose, title and non-infringement where legally permitted. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
12. Limitation of Liability
To the maximum extent permitted by law, MonkPop and its affiliates, officers, employees and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or opportunities, arising from or related to the service, user conduct, events or third-party services. Where liability cannot be excluded, our aggregate liability will be limited to the greater of the amount you paid MonkPop during the twelve months before the event giving rise to the claim or USD 100.
These limitations do not apply to liability that cannot be limited under applicable law, including liability for fraud, willful misconduct, gross negligence, death or personal injury where exclusion is prohibited. Your local consumer rights remain unaffected.
13. Governing Law and Disputes
Before filing a formal claim, you and MonkPop agree to try in good faith to resolve the issue by contacting support@monkpop.app and allowing a reasonable time for response. These Terms are governed by the laws applicable to MonkPop’s principal place of business, without regard to conflict-of-law principles. The competent courts in that location will have jurisdiction, except that consumers may bring claims in another court or rely on mandatory protections where local law provides that right.
14. Changes to the Service or Terms
We may update the service and these Terms for legal, safety, technical or operational reasons. The current version will be posted with its effective date. For material changes, we will provide reasonable notice where required. Continued use after the effective date means you accept the revised Terms; if you do not agree, you must stop using the service and may delete your account.
